What to include in a notice

A valid DMCA notice under 17 U.S.C. § 512(c)(3) must include all of the following:

  1. A physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work claimed to be infringed.
  3. The URL(s) on brainmatter.com of the allegedly infringing material, with enough detail for us to locate it.
  4. Your name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the owner.

Counter-notice

If material you posted was removed because of a DMCA notice and you believe it was removed in error, you may send a counter-notice under 17 U.S.C. § 512(g) to the same agent, including identification of the removed material, a statement under penalty of perjury that you have a good-faith belief the removal was a mistake, your contact information, and consent to the jurisdiction of the federal court for the district where you reside (or, if outside the U.S., for the District of Delaware).

Repeat infringers

We will, in appropriate circumstances, disable and/or terminate access for repeat infringers.

Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages. Do not file false claims.
